WILMINGTON, Del. - A Delaware killer, has once again been sentenced to death. 41-year-old James Cooke Jr., who is convicted of raping and killing 20-year-old University of Delaware student Lindsey Bonistall back in 2005, has been sentenced to death again, after a retrial.
Cooke was first sentenced in 2007 but the ruling was overturned by the Delaware Supreme Court in 2009, after they discovered that, with out his permission, his public defenders argued that he was guilty but mentally ill.
After being sentenced for a second time, Cooke came out and reportedly said that he still maintains his innocence and blames a corrupt judicial system.
Attorney General Beau Biden made the following statement after the sentencing: "Nothing changes the fact that Lindsey will not return home with her Mom, Dad, and Sister to Westchester County today, however, the sentence handed down reflects the brutality of her attack and murder. Lindsey's legacy lives on every day in many ways, including through her sister and baby niece and through the foundation her Mom and Dad established which is dedicated to promoting safe and peaceful living environments in off-campus communities."
A jury voted 11-to-1 in recommending the death sentence for Cooke.
