GEORGETOWN, Del. - Back in 2011, Derrick Powell was sentenced to death in the killing of Georgetown Police Officer Chad Spicer. Now, just over a year later, the Delaware Supreme Court has heard oral arguments in an appeal filed by Powell.
His defense lawyers argue that the sentence should be overturned because it was based on insufficient evidence, was disproportionate, and the sentence amounts to cruel and unusual punishment.
The State disagreed and argued the sentence should be upheld. No word yet, on a ruling.
