Leggs' Murder Indictment - Latest News

SALISBURY, Md. - More details involving the death of Sarah Foxwell were released Tuesday morning. Many on the shore were devastated, when 11-year-old Sarah Foxwell's body was found on Christmas day, in the area of Melson Road, Delmar.
The man charged in her abduction, Thomas Leggs Jr., now faces more severe allegations. "Yesterday the Grand Jury for Wicomico County indicted Thomas Leggs Jr. for First Degree Murder for Sarah Foxwell," said Davis Ruark the Wicomico County State's Attorney. Leggs is also being charged with First and Second Degree Sexual Offenses. "The autopsy was very thorough, the bottom line was that Sarah died of multiple injuries. It was a very detailed autopsy," said Ruark.
To protect the case prosecutors are keeping the details limited, but say there is evidence that will allow them to seek the death penalty. "One of them is that there's DNA or other biological evidence that tends to link a defendant to the crime of murder," said Ruark.
Family still live in the home on Bennett Road, once shared with Thomas Leggs Jr. A neighbor says things have been quiet in the neighborhood since his arrest. "They put up a no trespassing sign in the yard and you didn't see much of anybody over there," said Aaron Coker, who lives next to the family of Leggs. Coker is a father of a 5-year-old girl. He says he's happy to hear that the registered sex offender is out of the neighborhood and he hopes it stays that way. "Much relief, much relief. I think something should have been done a long time ago and he shouldn't have been on the streets, not the way he was," said Coker.
Leggs has been in custody since December 23, 2009, for the offenses of First Degree Burglary and Kidnapping. Officials say he will continue to be held without bond. The State's Attorney says they plan to file for the death penalty and life without parole by the end of the month.
Filing for the death penalty will automatically allow Leggs to move the trial out of Wicomico County. Prosecutors say currently there is no timeline of when the trial will start for Leggs.
